Comparison of employment law in UK and South Africa
One of the reasons we chose Durban, South Africa, as our offshoring destination is because of the similarities it shares with the UK. One particular area where we’ve had a lot of questions is how employment law in South Africa compares to that in the UK.
Employment law is an important aspect of any country’s legal system. It outlines the rights and obligations of employers and employees, and aims to ensure fair treatment for all parties involved in the employment relationship.
The UK has a long history of employment law, dating back to the Industrial Revolution. The current system is based on a combination of common law, statute law, and European Union (EU) law. In contrast, South Africa’s employment law is much more recent, with the country only achieving democracy in 1994. The current system is based on the Constitution of South Africa, as well as a range of other legislation.
We have produced a guide outlining a number of comparisons between employment law in the UK and South Africa, including:
Probation periods
Termination period
Maternity leave
Sick leave
Annual leave and bank holidays
